Dominic Kennedy has confirmed in The Times that the CPS did fail to disclose the Notes prior to Eddie's trial in July 1993. The Times understands that Eddie's previous defence lawyers were sent the notes in August 1995.

The CPS nonetheless today insisted that time of death had been properly dealt with at Eddie's trial. Mr Whittaker, Chief Crown Prosecutor for Merseyside CPS, said: "The transcript of evidence given at the trial by both the police surgeon and the pathologist reveals that the issue of the time of death was fully explored before the jury at the trial.

But, CPS statement raises new questions about Merseyside Police's conduct. Not only does it show that the force inexplicably kept the notes from prosecutors until after the trial. But the statement also suggests that the force may have misled the Police Complaints Authority's (PCA) critical inquiry into the Gilfoyle murder investigation in 1994.

21st - 25th February 2009

Dominic Kennedy has discovered notes that suggest that Paula died while he was at work. Notes that were written (and apparently 'lost', according to the police) by the police doctor on the scene estimated that the time of death of Paula was 6 hours prior to her being found, which means that Eddie could have had an albi at his trial because he was at work at this time. The failure to disclose these notes at the trial has made it a possibility for a re-investigation of his case. Fingers crossed! 20th - 25th February 2009

Dominic Kennedy, the deputy editor of The Times newspaper has written several articles about Eddie and his case, some of which have made the front page. The case has been in the newspaper all week! You can read these articles by either looking it up on the times online website (type in eddie gilfoyle into the search engine - click the most recent articles), or click

This is really good news as this new establishment is a category 'D' prison or open prison. Conditions for Eddie will therefore be far more favourable for him. We have to thank the hard work of Eddies solicitors who against all the odds successfully argued at a recent parole hearing that Eddie should be de-categorised from closed conditions to open conditions notwithstanding that Eddie was maintaining his innocence. Often, prisoners who claim innocence never get through a parole board as they are viewed as in denial of the offence and a continuing risk to the public. Such prisoners are often kept in closed conditions and have in the past served sentences way beyond their tariff sentence. Despite Eddie refusing to take part in any prison courses specifically designed to address his alleged offending behaviour, on the basis that he has done nothing wrong, his lawyers successfully argued that Eddies behaviour in prison has been exemplary from day one and that all psychological evaluations of Eddie by the authorities had concluded that he was not a risk and he should therefore be de-categorised. A great result and a step closer to his eventual release.

In the meantime, Eddies solicitors are working extremely hard on his case and are putting together evidence for submission to the Criminal Cases Review Commission, a requirement necessary for a new appeal
